Welcome to Bid Buddie Application

  1. Bid Buddie customised mobile application is confidential to and the property of Econet Wireless (Pvt) Ltd. All access and use of the website and the features of the website are governed by these terms and conditions of use. These terms apply to all individuals who use, visit or browse the mobile application.
  2. By accessing or using the application to include both listing, bidding, viewing or watching, you and the entity you are authorised to represent signify your agreement to be bound by these terms

Privacy Policy

  1. The Customer and/or User hereby acknowledge and agree that: they are required to furnish Econet with personal information and other data in terms of the agreement to allow for the online bidding and auction. The Customer undertakes to provide such data and personal information as required in the application and to provide Econet with amendments to such data and personal information as and when such amendments occur. 
  2. Econet undertakes to only use the personal information for the purpose of administering the Agreement and shall only disclose such personal information  to such of its third party business partners as is necessary to enable the provision of the Services and/or if required to do so in terms of the law.

Bidding and Listing Terms and Conditions.

  1. All auctions are open only to people aged 18 or over, who unconditionally agree to be bound by the jurisdiction of the Zimbabwean courts.
  2. By registering to an auction you agree to be bound by the event terms and conditions. Personal information will be treated in accordance with the BID BUDDIE privacy policy, which is incorporated by reference in its entirety in these Terms.
  3. All bids are final and binding. If a bid is received in error then the promoter CAN remove the bid, BEFORE THE CLOSURE OF THE AUCTION, for you at their discretion.
  4. Bids must be in a specific currency and be received by the promoter by the time indicated at the event by the promoter. All winning bids must be above the reserve price for the item or at the discretion of the promoter.
  5. All lot descriptions are provided by the promoter and as Bid Buddie take no responsibility whatsoever for the accuracy of descriptions. It is the responsibility of the bidder to check with the promoter any details or descriptions of any lot.
  6. The promoter will run the auction in a fair and consistent manner, however – for the avoidance of doubt, the promoter’s decision is final and for any bid to be counted must be received by the promoter before the close of the auction. It is the responsibility of the bidder to ensure their bid is received.
  7. The bid shall be valid for the period specified by the promoter.
  8. Content that violates any of Bid Buddie’s policies may be modified, obfuscated or deleted at Bid Buddie’s discretion.
  9. Bid Buddie will have the right to monitor and edit content, whether it be product content, reviews, comments or otherwise. This is to help ensure there is no disputes between users in the event that there is abusive, explicit or illegal content being promoted.
  10. The use of the platform does not guarantee the ownership of any content, software, code, data, or materials you may access on the platform.
  11. Bid buddie will not be liable for any failure or interruption of service, breach of contract, theft or any other problems resulting from usage of the platform.
  12. The user will assume legal responsibility of any loss or damages caused by the user’s activity of the platform.
  13. Terms & Conditions may change from time to time as the business grows and adapts to trends, technology, and new laws, and will need to adjust our Terms & Conditions accordingly

Suspension and termination

  1. In the event that any of the provisions of these terms and Conditions are not followed, Bid Buddie reserves the right to suspend or terminate your access to the Service. Such terminations of service may at the discretion of Econet be informed by non-compliance to user registration rules and bidding or listing rules.

Disclaimer of warranties

  1. Neither Econet, Connected Lifestyle nor any of their officers, directors, employees or representatives represent or warrant
    1. That the service, including its content, will meet your requirements or be accurate, complete, reliable, or error free;
    2. That the service will always be available or will be uninterrupted, accessible, timely, or secure;
    3. That any defects will be corrected, or that the service will be free from viruses, “worms,” “trogan horses” or other harmful properties;
    4. The accuracy, reliability, timeliness, or completeness of any review, recommendation, or other material published or accessible on or through the service or the site;
    5. The availability for sale, or the reliability or quality of any products
  2. You acknowledge that due to the nature of the Internet, we cannot guarantee that access to the application will be uninterrupted or that e-mails or other electronic transmissions will be sent to you or received by us

Limitation of liability

  1. Connected Lifestyle (Bid Buddie) does not provide any warranty in respect of any direct, indirect, special, punitive, incidental, exemplary or consequential damages, even if such party has been previously advised of the possibility of such damages, whether in an action, under contract, negligence or any other theory, arising out of or in any way connected with the use, inability to use or performance of the application. These limitations shall apply notwithstanding any failure of essential purpose or the existence of any limited remedy. 
  2. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply.

Governing Law

  1. This Agreement shall be governed by, construed or otherwise interpreted in accordance with the Laws of Zimbabwe. The Customer and/or User shall comply with all applicable laws and governmental regulations.

Jurisdiction

  1. The Customer and/or User agree to submit to the jurisdiction of the Magistrates Court in Harare in the event of any dispute leading to litigation arising out of matters in terms of this Agreement or connected there to, and in the event that Customer is found liable he shall be obliged to pay Econet costs at a legal practitioner-client scale and all other costs and collection commission incidental thereto and so charged.
